Terms and conditions

General and Definitions:

These Terms and Conditions apply to the rental agreement for all vacation accommodations of Borgo Luna Rossa S.r.l. (BLR) in Castellino Tanaro, Italy. By making a reservation, tenants agree to these terms and conditions.

Tenant(s): The person who rents the accommodation for a specific time and has paid the agreed rent to the landlord for it.

Landlord: Being Borgo Luna Rossa S.r.l., or its representative/manager who rents the accommodation to the Tenant.

Rental Agreement: Agreement between the tenant and the landlord regarding the rental of the accommodation.

Guest(s): The person using the rented accommodation.

Rental price: As stated on the booking confirmation, which is increased by the weekly cost for final cleaning and tourist tax. All prices include VAT.

Rental Period: The period between check-in/check-out as described in the rental agreement.

Reservations and payments

The landlord informs the tenant about the rented accommodation, facilities, prices and conditions through the booking confirmation. Reservations are confirmed upon receipt of a deposit of 40% of the total rental price. The remaining amount must be paid 60 days before the check-in date. In case of a reservation within 60 days before the check-in date, 100% payment is required at the time of booking the accommodation.

If 100% of the payment is not made 60 days prior to check-in, the landlord reserves the right to cancel your reservation without refund of the deposit made.

Upon arrival your bed is of course neatly made and there is/are plenty of bath linen and kitchen utensils. This service as well as a filled refrigerator upon arrival is included in the price. Also, if you wish, the bed linen can be changed every Wednesday free of charge.

Cleaning is provided weekly by BLR regardless of the agreed rental period, for this service the tenant must allow the cleaning team access to the rented accommodation. The cleaning fee is a mandatory additional cost.

By law, the rental fee will be increased by tourist tax.

Charges for extra services such as organized dinner events, bicycle rental, electric car charging, extra change of bed/bath linen, etc., among others, must be paid by the tenant on the spot the day before departure.

Payment Methods: Payments can be made via cash payment, bank transfer or other agreed upon methods.

Cancellation Policy: For cancellation more than 120 days before the check-in date, 100% of the prepaid rental amount will be refunded. For cancellations between 120 and 60 days before the check-in date, 50% of the prepaid rental amount will be refunded. For cancellations less than 60 days before the check-in date, there will be no refund.

No-show: If the Lessee does not arrive on the check-in date without cancellation and/or notification, the Lessee will owe the full rental fee and any additional costs. In this case, the landlord is entitled to re-rent the accommodation to third parties.

Deposit: At the start of the rental, the tenant pays a deposit equal to 15% of the high season rent, which the tenant will receive back within 10 business days after departure, provided nothing is missing or damaged during the duration of the stay. Minor damage or loss will be deducted directly from the security deposit. If the deposit is not sufficient, the difference will have to be paid in addition.

Check-In and Check-Out

Check-In time: from 4 p.m. on the day of arrival.

Check-Out time: before 10:00 am on the day of departure.

From 10:00 a.m. you must allow our cleaning crew access to clean the accommodation for the next tenant.

Changeover days

In high season (week 25 to week 38) the changeover day of the accommodation is Saturday. The minimum length of stay in high season is 1 week.

 

Intermediate season is from:

  • Week 21 through week 24
  • Week 39 through week 42

In the off-season, the minimum stay is 4 nights and the arrival/departure day is negotiable.

 

Low season is from:

  • Week 16 through week 20
  • Week 43 through 46

In the low season, the minimum stay is 3 nights and the arrival/departure day can be agreed upon.

Occupation and use

Maximum Occupancy: The maximum number of guests is as specified in the rental agreement and as described in the accommodation description on our website and is intended only for the named persons in the rental agreement. Exceeding this limit may result in additional charges or termination of the rental agreement.

Upon arrival, the renter checks the accommodation for defects, damages and potentially unsafe situations and notifies the landlord within 24 hours of arrival. The landlord will then take the necessary steps to remedy this within a reasonable period of time.

If your booking falls outside the period of week 21 to 42, the pool may be closed. The pool is connected to solar panels. With these we try to extend the swimming season as much as possible.

To respect the privacy and tranquility of the other guests, BLR’s grounds are only exclusively accessible to tenants. Visits from family, friends and acquaintances are allowed only when agreed in advance with the landlord for a few hours only and possibly at a further agreed increase in the rental price. These visitors are not allowed to use the public parts and facilities of BLR (e.g. swimming pool, charging stations, etc.). The lessee is responsible for its invitees in this event.

Silence Hours: All guests are expected to observe silence hours between 10:30 p.m. and 8 a.m. to respect other guests and neighbors.

Responsibility and liability

Insurance: The renter is advised to purchase cancellation and travel insurance for cancellations, accidents, health problems and loss/damage to personal belongings.

The tenant is severally liable for all loss and/or damage to the rented accommodation and its inventory, regardless of whether this is the result of acts or omissions of the tenant or third parties who are in or around the rented accommodation with the permission of the tenant. If the rented accommodation is used or left behind incorrectly, the costs will be charged to the renter. The lessor is entitled in advance to hold the lessee liable even after the end of the rental period, if damage caused has not been paid for or has not been paid for properly. All associated costs will be borne by the tenant. Please report any damage immediately to the landlord.

House Rules

Smoking: Smoking in the accommodation is strictly prohibited. In case of fire due to smoking, BLR is not insured and the tenant is fully liable in case of consequence. Outside smoking is only allowed on your own private terrace at the accommodation, not at the pool and other public areas.

Pets: Pets are unfortunately not allowed.

Energy and water: Normal consumption of energy and water is of course included in the rent, however, if excessive consumption is observed it may result in additional charges to the tenant.

Cleanliness: Tenant is expected to leave the accommodation clean and tidy. Additional cleaning fees may be charged or deducted from the deposit if the accommodation is left excessively dirty. We ask that you return moved furniture to its original place. Damage, defects and missing items must be reported to the landlord before departure.

Liability

The landlord accepts no liability for:

  1. theft, loss or damage of any kind to the renter during or as a result of the rental of and stay in the rented accommodation.
  2. failure or malfunction of technical equipment in the accommodation, including, among others, internet/wifi connections, heating/air conditioning systems, interruption of utilities, access routes, etc.
  3. damage or injury resulting from the use of the accommodation, including inventory, or accidents in and around the accommodation.
  4. the landlord is not liable for nuisances caused by nature (Storm, flood, presence of insects and animals, etc)
  5. the landlord has no legal life-guard obligation at the pool and is therefore not liable for supervision of the pool; use of the pool is entirely the tenant’s own responsibility. Entering the pool without swimming skills is not allowed. The pool is 1.30m deep, therefore diving is not allowed.
  6. non-performance or partial performance of the lease in the event of force majeure or unforeseen circumstances.

The landlord will make every effort to provide accurate information to the tenant, but is not liable for unexpected inaccuracies and/or omissions in the information provided.

All disputes between Tenant and Landlord shall be governed by Italian law.

Termination clause

Landlord reserves the right to immediately terminate the rental agreement without refund if tenants fail to comply with these terms and conditions.

In case of force majeure or unforeseen circumstances, the landlord may cancel the reservation. In this case, the landlord will proceed to refund all or part of the rent already paid for the rental period that has not yet expired without owing any compensation. The landlord is obliged to notify the tenant of the cancellation and the circumstances of the force majeure. The landlord is never liable for the cost of services booked by the tenant himself (for example: airline tickets, car rentals, hotel stays, etc.).
